IX. Dispute Resolution
1. Procedures for Resolving Disputes
At New2Work, we aim to provide a transparent, fair, and efficient mechanism for resolving disputes that may arise between users of the platform or between users and New2Work. The following outlines our comprehensive approach to dispute resolution:
Initial Dispute Resolution: We strongly encourage users to attempt to resolve any disputes directly with the other party before pursuing formal resolution methods. This involves communicating clearly and in good faith to find a mutually satisfactory solution.
Contacting New2Work: If direct resolution is not possible or if the dispute involves a potential violation of our Terms of Service, users should contact New2Work’s customer support team. Users can report disputes by providing a detailed description of the issue, including any relevant communications, documentation, or evidence that may assist in resolving the dispute. New2Work will review the submitted materials and may mediate to facilitate a resolution.
Formal Dispute Resolution:
- Mediation: If the dispute cannot be resolved through direct negotiation or New2Work’s intervention, the parties may agree to mediation, wherein a neutral third party will assist them in reaching a voluntary agreement. Mediation expenses, unless otherwise agreed upon, will be shared equally between the parties.
- Arbitration: For disputes that are not resolved through mediation, arbitration may be considered as a final, binding resolution. The arbitration will be conducted by a neutral arbitrator in accordance with the rules of an agreed-upon arbitration institution. The decision of the arbitrator will be considered final and binding on both parties. Each party will be responsible for its own costs related to the arbitration, and the parties will share equally the arbitrators’ fees and any administration fees.
2. Governing Law and Jurisdiction
- Governing Law: These Terms of Service and any dispute arising out of or related to it will be governed by the laws of the jurisdiction in which New2Work is registered, without regard to its conflict of law provisions.
- Jurisdiction: Except as otherwise agreed by the parties or as described in the arbitration option above, you agree to submit to the jurisdiction of the courts located within the jurisdiction where New2Work is registered, for the resolution of all disputes arising out of or related to the use of the platform and services provided by New2Work.
3. Waiver of Class Action: Users agree to resolve any disputes on an individual basis, and they waive any right to participate in class actions, class arbitrations, or representative actions or arbitrations.
4. Changes to Dispute Resolution Policy: New2Work reserves the right to modify these dispute resolution procedures at any time in accordance with the terms set forth in the “Changes to Terms” section of this agreement.
This dispute resolution section will survive the termination of any or all of your transactions with New2Work.

XIII. EU Specific Provisions
New2Work is committed to providing services that comply with European Union (EU) regulations and directives, ensuring that users within the EU are afforded specific rights and protections in accordance with EU consumer protection laws, the General Data Protection Regulation (GDPR), and other relevant EU legislation. This section outlines the EU-specific provisions that apply to users accessing and using New2Work from within the European Union.
1. Compliance with EU Consumer Protection Laws
- Right to Withdraw from Online Contracts: In accordance with the EU Consumer Rights Directive, EU users have the right to withdraw from online contracts (including subscriptions to services) within 14 days of the contract’s conclusion without giving any reason. To exercise this right, users must inform New2Work of their decision to withdraw from the contract by an unequivocal statement (e.g., a letter sent by post or email). If users withdraw from a contract, New2Work will reimburse all payments received from the user, including the costs of delivery (except for the supplementary costs arising if the user chose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than 14 days from the day on which we are informed about the decision to withdraw from the contract. New2Work will carry out such reimbursement using the same means of payment as the user used for the initial transaction unless the user has expressly agreed otherwise; in any event, the user will not incur any fees as a result of such reimbursement.
2. Cross-Border Dispute Resolution Mechanisms
Online Dispute Resolution (ODR) Platform: The European Commission provides an Online Dispute Resolution Platform (ODR) available at http://ec.europa.eu/odr, which allows EU consumers and traders to resolve disputes related to online purchases of goods and services without going to court. New2Work users residing in the EU are encouraged to use this platform for resolving disputes.
Alternative Dispute Resolution (ADR) Entities: EU users may also have the option to resolve their disputes through Alternative Dispute Resolution entities. New2Work agrees to participate in dispute resolution proceedings before an ADR entity when required by EU legislation.
3. Specific Rights and Protections for EU Users
GDPR Compliance: New2Work adheres to the General Data Protection Regulation (GDPR), ensuring the protection of personal data and privacy of EU users. This includes rights to access, rectification, erasure, and portability of personal data; the right to withdraw consent; and the right to lodge a complaint with a supervisory authority.
Fair and Transparent Contracts: Terms and Conditions, including privacy policies, are provided in a clear, understandable, and easily accessible format, complying with the EU’s requirement for transparency and fairness in user contracts.
Protection Against Unfair Contract Terms: New2Work’s Terms and Conditions are designed to ensure that they do not create a significant imbalance between the parties’ rights and obligations to the detriment of the consumer, in accordance with the EU Directive on Unfair Contract Terms.
Consumer Protection in E-commerce Transactions: New2Work follows the directives related to e-commerce in the EU, providing consumers with specific information before the conclusion of the online contract, confirming the receipt of the order without undue delay, and ensuring the security of online payments and personal information.
These EU-specific provisions ensure that New2Work’s services are fully compliant with EU regulations, offering additional rights and protections to our users within the European Union. New2Work is dedicated to upholding these standards, ensuring a secure, transparent, and fair environment for all users.
